Alcohol Labeling

An official with a state department of health contacted the Network requesting information on whether existing federal law preempts a state legislature from adding labels warning about negative health consequences of alcohol products for human consumption. The Network researched the inquiry, reviewing federal regulation 27 CFR 16.32 and relevant case law. The Network also reached out to a contact at the National Policy & Legal Analysis Network to Prevent Childhood Obesity for additional analysis. Within a week of initial inquiry, the Network informed the official that the federal government has explicitly preempted the state’s desired action.
